UC2B Expansion Commitment Agreement

In furtherance of UC2B’s private expansion efforts, I hereby agree to remit a commitment fee commensurate with my commitment level by July 30, 2012. If and when UC2B is successful in procuring community-wide fiber build-out through a commercial internet service provider, I further agree to remit an installation fee commensurate with my commitment level, with such payment due when fiber build-out construction commences in my neighborhood. Additionally, I acknowledge and agree that, if UC2B is successful in procuring community-wide fiber build-out, I shall subscribe to internet service through the chosen commercial internet service provider for a period of at least 12 months after such service becomes available in my neighborhood. Moreover, I acknowledge that, if UC2B successfully procures community-wide fiber build-out, I shall be entitled to recoup both the commitment fee and the installation fee through a recurring discount on my monthly bill for internet service.

I further acknowledge and agree that my agreement to remit a commitment fee constitutes a pledge of good faith intended to assist UC2B in its effort to procure community-wide fiber build-out, but in no way guarantees or reserves to me specific rights concerning UC2B private expansion to my property or neighborhood.

In the event that UC2B is not successful in procuring community-wide fiber build-out, the commitment fee shall be fully refundable.
